Terms and Conditions
- The Competition will run on www.massivernb.com website
- Closing date for entries: 31/01/2010.
- The competition is open to all citizens of the UK and Republic of Ireland of 16 years of age and over, except employees of UMTV, a division of Universal Music Operations Limited and their associated, affiliated or subsidiary companies, and their families, agents, or anyone connected with this Competition. Winners under the age of 18 years will require parental consent to attend the photo-shoot and must be accompanied by a person aged 18 or over to the photo-shoot.
- Entry limited to one per person
- No purchase is necessary but entrants should be aware that they may be subject to local call charges depending on their own individual arrangements for Internet access.
- An eligible entrant must be an individual resident in the UK or Republic of Ireland and must submit an entry with two recent photos of the entrant (one a head shot, and the other a clothed full body shot) including their name, address and e-mail address. Re-touched photos will not be accepted. [Entrants are also invited to submit video footage of themselves together with their photo.] Entries may be rejected in the sole discretion of Universal Music, including for reasons of obscenity, defamation or invasion of privacy.
- Universal Music will not be liable for any failure of receipt of entries. Universal Music takes no responsibility for any entries that are lost, delayed, illegible, corrupted, damaged, incomplete or otherwise invalid. Further, Universal Music Operations Limited will not be liable for technical, hardware, or software failures of any kind or lost or unavailable network connections which may limit or prohibit an eligible entrant's ability to participate in the Competition.
- By entering and submitting a photograph, all eligible entrants agree to abide by each and all of these General Rules, the Terms and Conditions and Terms of Use and the Security and Privacy Policy that govern www.massivernb.com. If the entrant is under 18 years of age they must print a copy of all these terms and conditions for their parent or guardian to read and obtain their consent before entering the competition and submitting a photo. If a winner is under the age of 18 years, they must provide a letter of consent signed by a parent or guardian confirming the parent or guardian's consent to the winner attending the photo-shoot. If you do not agree to these Terms and Conditions or you are under 16 years of age, please refrain from submitting an entry and photograph to the competition.
- Universal Music reserves the right, with or without cause, to exclude entrants and withhold prizes for violating any of these General Rules and the Terms and Conditions and Terms of Use. Universal Music reserves the right to amend these General Rules. Any amendments will be published on the Website.
- All entries will become the property of Universal Music and will not be returned.
- By submitting a photograph and any other materials such as a video ("the Materials") with an entry the entrants agree to grant Universal Music a non-exclusive, fully paid and royalty free, sub-licensable and worldwide licence to use, edit, modify, display, publish, perform, reproduce, communicate, and distribute the Materials on or through the Website. For the avoidance of doubt, all entrants agree to the free use of their names, photographs and general locations for publicity and news purposes during this and future promotions in any and all media by Universal Music or any associated or subsidiary company of the Universal Music Group of companies and Universal Music shall be entitled to display the Materials on the Website. Universal Music shall not acquire any right, title or interest to the intellectual property rights in the Materials, except as provided in this clause. If a person does not wish to grant Universal Music such rights in the Materials then they should refrain from entering the competition. Also, by submitting the Materials with an entry, the entrant warrants that they are free to grant such rights in the Materials to Universal Music and agree to indemnify Universal Music in respect of any claims, damages and costs arising as a result of the entrant's breach of this warranty.
- The winner and runner up selected by the judging panel will be styled, made up and photographed at a studio photo shoot in London. The winners will be chosen at the panels sole discretion. The winner and runner up will both receive 10 photos from the shoot and one of the winner's photographs being used as the cover for the next released edition of "Massive R&B". Each of the five top entries will receive a Universal goodie bag. No cash or prize alternative will be offered
- The winners will be notified by e-mail within 24 hours of the closing date. All reasonable endeavours will be made to contact the winners during this time. If a winner cannot be contacted before this time on the mobile number or email address supplied by the entrant with their entry, the promoter reserves the right to Select an alternative winner. A list of the winners will be posted on the website once the winners have been notified.
- Entrants must be available during normal working hours of 9am to 5.30pm to attend the photo-shoot in London. Universal Music will notify the winner of the date and time of the photo-shoot closer to the time.
- Universal Music will liaise with the winners to arrange their travel to the photo-shoot in London and will reimburse the winners reasonable travel costs approved in advance and the reasonable travel costs of any chaperone for winners under the age of 18. Incidental expenses are not included.
- The judges' decision is final and binding on the entrants. No correspondence will be entered into.
- The judges reserve the right to not select an overall winner if none of the entries are deemed to be of high enough quality for the cover of the album.
- There is no cash or other alternative to the prizes stated and the prizes are not transferable and no part or parts of the prize may be substituted for other benefits, items or additions.
- Uses of personal data received by Universal Music Operations Limited in the course of the promotion are subject to the privacy policy found on the Website. Winners' names may be published on the Website.
- By entering the competition all entrants are deemed to have accepted and be bound by these General Rules.
- Universal Music reserves the right at any time to cancel, modify or supersede the competition (including altering prizes) if, in our sole discretion, a competition is not capable of being conducted as specified.
- Nothing in these terms and conditions shall limit Universal Music's liability for death or personal injury caused by their employees or agents' negligence or for fraud.
- If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive, remain in full force and effect.
- These terms and conditions shall be governed by English law and the courts of England shall have exclusive jurisdiction.
- The promoter of this prize draw is Universal Music Operations Limited.
